Mobile Privacy Policy and Terms and Conditions

Welcome to the SEA App.  We hope you will find it helpful in getting around Seattle-Tacoma International Airport.  The Terms of Use/End User License Agreement and Privacy Policy terms and conditions follow

 

This Terms of Use/End User License Agreement and Privacy Policy (“Agreement”) is between You, the user, and the Port of Seattle owner of the Seattle-Tacoma International Airport (“SEA” or “we” or “us” or “our” as grammatical usage requires) regarding use of the SEA App (also just “App”).  IF YOU DO NOT AGREE TO THE TERMS OF SERVICE/END USER LICENSE AGREEMENT AND PRIVACY POLICY, DO NOT USE THE SEA APP AND UNINSTALL THE APP.

 

1.  SEA hereby grants You a personal, non-transferable, non-sublicensable, limited, non-exclusive, revocable license to use the SEA App for its intended purposes.  The SEA App’s purposes are to provide You information about SEA Tac, about navigating around SEA Airport, about flights, and about concessions that you may be interested in that are near you or on your way (this may occur if you search for a kind of seller, coffee for example, or if we identify your location).  We may expand what information the Sea-Tac App provides at any time.  THE SEA APP IS USED AT YOUR OWN RISK.

 

2   SEA-TAC AND ITS VENDORS AND LICENSORS ARE NOT RESPONSIBLE FOR THE ACCURACY OF ANY INFORMATION PROVIDED VIA THE SEA APP.  SEAACCEPTS NO LIABILITY WHATSOEVER FOR ANY ERRORS IN THE INFORMATION PROVIDED VIA THE SEA APP, REGARDLESS OF WHETHER THE INFORMATION ORIGINATES WITH US OR A THIRD PARTY. 

 

3. SEA AND ITS VENDORS AND ITS LICENSORS ARE NOT LIABLE FOR LOSS OF USE, LOST DATA, FAILURE OF SECURITY MECHANISMS, MISSED FLIGHTS, DAMAGE OR OTHER EFFECT ON THE MOBILE DEVICE YOU DOWNLOAD THE SEA APP ON, FAILURE OF THE SEA APP, OR DAMAGES OF ANY KIND, WHETHER DIRECT OR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL, REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT OF ANY KIND, STRICT LIABILITY, ETC.), EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE.

 

4.  You may not:
            a)  reproduce, distribute, sell, sublicense, rent, loan, lease, or otherwise commercially use the App
            b)  reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App
            c) use the App in a way that violates federal or state law.

 

5.  You are responsible for any charges your carrier may impose for messages or data when using the SEA App.

 

6.  THE SEA-APP IS PROVIDED TO YOU “AS-IS,” WITH NO WARRANTY WHATSOEVER, BY SEA AND ITS VENDORS AND LICENSORS. 
You can use the App to find sellers of various products and services (“Sellers”).  WE MAKE NO WARRANTY WHATSOEVER WITH RESPECT TO SELLERS OR THEIR RESPECTIVE PRODUCTS AND SERVICES.  YOU USE ANY SUCH SELLER AT YOUR OWN RISK.

 

7.  SEA  and its vendors and licensors retain all right, title and interest in the SEA App.  This Agreement provides you only the right to use the Sea-Tac App and no other rights.  The SEA App is protected by law, including without limitation the copyright laws of the United States and other countries, and by international treaty provisions.  If You provide us with any feedback regarding the SEA  App, you hereby transfer all right, title and interest in any such feedback to us.  If we make any changes to the Sea-Tac App based on any such feedback, You will have no rights in such changes and no right to any compensation for such changes.

 

8.  This Agreement is governed by the laws of the State of Washington, excluding its choice of law rules.  This Agreement is the entire expression of the Agreement of the parties with respect to the SEA App.  This Agreement may only be amended in writing, signed by a person authorized to sign on behalf of SEA.

 

9.  The SEA App collects no personally identifying information.  The only data provided to us is data You enter into the SEA  App, for example when you select a flight that you are taking.  This data is not encrypted.  We may collect location information, terms you search on (for example, books or coffee), and SEA App usage data.  This information is anonymized.  Some of this anonymized information may be shared with our licensors. If you do not want us sharing this information, do not use the App.  Other than the information described in the previous sentence, we do not collect any information about you, nor do we share it with anyone except as described in that sentence. We do not share any of the data you enter with anyone except to the extent necessary to get the requested information.

 

10.  For some of our Sellers, a link to their website is provided in the App.  If you go the website o f a Seller then you will be subject to the Seller’s privacy policy.  We are not responsible for their privacy policy, nor for anything else that you may do on such a Seller’s website.  YOUR USE OF A SELLER’S WEBSITE IS ENTIRELY AT YOUR OWN RISK.
